Important and clear regulations.

Valid from January 4, 2010


1. General provisions:


1.1. These terms indicate the order of DPD Lietuva rendered services, requirements for shipment packaging, services order submission, and limitations of rendered services for domestic and international deliveries.
1.2. Customers have to familiarize with the regulations of shipment delivery before submission of shipment delivery order or signing of agreement.
1.3. Regulations of shipment delivery supplement and elaborate the conditions presented in the parcel delivery agreement between DPD Lietuva Ltd. and a Customer. If there are contradictions between these regulations of shipment delivery and the signed agreement with a Customer, priority is favoured to provisions described in the signed agreement with Customer.


2. Concepts applied in the regulations:


DPD - DPD Lietuva Ltd. is a provider of courier and postal services.


Courier services are pick-up, distribution, shipping and delivery services for registered postal shipments and postal correspondence parcels (further – parcels) rendered for a Receiver via a Courier according to DPD determined order locally and internationally. 

 

Registered postal shipment is a shipment having a constant value DPD guarantee in case of shipment loss, theft or damage.


Postal correspondence parcel is a correspondence parcel (a letter, a parcel in an envelope, etc.). In case of loss, theft or damage there is covered amount even to this type of parcel delivery costs.


Domestic services - pick-up of shipments (acceptance), sorting, shipping and delivery (signed delivery) in the territory of the Republic of Lithuania via DPD network.


International services - pick-up of shipments (acceptance), sorting, shipping and delivery (signed delivery) via DPD network from/to the Republic of Lithuania.


Parcel - one unit (an envelope, a box, a roll, a pallet and so forth) of properly packed and labelled goods.


Shipment is one or several parcels, described in one shipment transmission document, and sent by one Sender to one Receiver.


Non-standard shipment is a shipment, which one of dimensions - length, width, height, volume or weight - exceeds proportions of standard parcel, indicated in 3.1. subsection of these Regulations.


Sender is a legal person presenting a shipment for its delivery to DPD for the indicated Receiver.


Receiver is a legal or private person to whom DPD is obliged to deliver a shipment presented by a Sender.


Shipment transmission document is a way-bill, manifest, bill of lading or other document drawn by a Sender, in line with which a Courier picks-up a shipment for delivery, confirming shipment delivery agreement and having a unique number (barcode) of shipment. A Sender is responsible for data correctness written in a shipment transmission document.


Proof of delivery (POD) is DPD electronic or paper document signed by a Receiver, and confirming shipment delivery and value added services (options) fulfilment.


Courier is a person working or representing DPD while picking-up shipments from a Sender and delivering them to a Receiver when a latter has to sign on delivery documents.


Mobile device unit (MDU) is an electronic gadget used by a Courier, and is up for shipment scanning, registration of value added services (options) and signature of parcel Receiver.


Value added services (options) are additional services rendered by DPD for additional fee and related to shipments delivery. Value added services (options) and their prices are indicated in the pricelist of DPD services.


Work day is any calendar day of the year which is stated as national work day in shipping, transit or delivery country.


3. Restrictions for shipment weight and measurements:


3.1. Maximum/minimum measurements and weight of a parcel and euro-pallet:

Non-standard parcel - a parcel that does not correspond to the indicated standards.
* Parcel volume – the sum of the smallest perimeter and the longest side.

Non-standard pallet is a pallet that does not correspond to europallet standards.

 

3.2. Parcels exceeding weight of 31.5 kg must be placed on standard europallets and presented for a Courier. 

 

4. Order presentation:


4.1. Order can be submitted only by a legal person paying for a shipment delivery and other requested value added services (options). International parcels can be delivered only to/from countries indicated in www.dpd.lt.
4.2. If a Customer does not have a signed agreement with DPD, an order for shipment pick-up can be accepted only from a Sender that agrees to pay in cash for shipment delivery during shipment pick-up moment according to the pricelist announced in www.dpd.lt.  
4.3. Ways to present an order:
- in DPD website www.dpd.lt (option Orders)
- by order line 8 700 55700 (local line only)

 

Order presented in website is taken as accepted only after receiving DPD confirmation to email indicated in the order. If confirmation is not received during 1 hour a Customer has to inform DPD about it by phone +370 5 210 6777.

 

5. Terms of order presentation:

II zone - region centres of Lithuania: Anykščiai, Birštonas, Biržai, Druskininkai, Elektrėnai, Gargždai, Ignalina, Jonava, Joniškis, Jurbarkas, Kaišiadorys, Kelmė, Kėdainiai, Kretinga, Kupiškis, Lazdijai, Mažeikiai, Molėtai, Naujoji Akmenė, Pakruojis, Palanga, Pasvalys, Plungė, Prienai, Radviliškis, Raseiniai, Rokiškis, Skuodas, Šakiai, Šalčininkai, Šilalė, Šilutė, Širvintos, Švenčionys, Trakai, Ukmergė, Varėna, Vilkaviškis, Visaginas, Zarasai.

 

III zone – other areas of Lithuania.

 

 

Remarks:

* A shipment is picked-up from a Sender on the same working day if the order is presented by the end of indicated term;

* A shipment has to be packed and labelled, and shipment documents have to be ready for delivery before order presentation;

* Order for fulfilment on the same working day has to be presented not later than 2,5 hour till the end of a Sender working day (for instance, if a Sender is in I zone, the order has to be presented by 3:20 p.m.  and has to work till 5:50 p.m.)

 

6. Parcel labelling:


6.1. Each separate parcel of a shipment must be marked by sticking DPD or shipment labels with a barcode prepared by a programme and requisites of a Sender and a Receiver. This data has to be sticked on the top of the biggest area of parcel flat. A label or marking cannot be sticked on junction of two flat packages.
6.2. DPD gives possibility to use shipment labelling program for Senders sending shipment constantly.
6.3. If a shipment labelling program is not used shipments have to be marked by requisites mentioned below:


Sender’s name, address, Receiver’s name, exact shipment delivery address: street, house number, postal code, city; (if this helps to find Receiver faster, it is necessary to indicate block, floor, room). It is preferred to indicate a contact Receiver person and a telephone, the number of sent parcels (1/5; 2/5;….; 5/5) and length, width and height of the shipment.


6.4. If it is foreseen, it is necessary to use DPD special labels, tapes for labelling certain services and/or value added services (options). Labels have to be sticked on parcels in a way they are visible; the tape has to be sticked on all flats of a parcel.

Remark: Lettering of notes on a parcel has to be not smaller than 5 mm height. Hand-written marking has to be done only in capital letters.

 

7. Packaging of shipments:


A Sender must follow the determined DPD requirements and pack shipments in such type of package that protects goods from damage while loading/unloading, sorting, shipping and storing. Goods in the shipments should not endanger people, nature, transport fleets, other shipments. Besides, a shipment should be protected from getting into its content without damaging the packaging. Goods and things required for temperature mode have to be handed over for delivery only in thermal containers.


8. Shipment hand-over to a Courier:


8.1. A Sender presents a prepared shipment for delivery to a Courier and a shipment transmission document. According these regulations there have to be indicated Sender’s and Receiver’s requisites, value added services (options) requested by the Sender. A Sender signs in a shipment transmission document indicating own name, surname and duties. A Sender fills in a shipment transmission document and assures exactitude of presented data in it.
8.2. If a shipment is sent to non European Union countries, a Sender must assure there is presented all data and documents, necessary for fulfilment of import and export custom and other formalities, together with a parcel.
8.3. A Courier accepts Sender shipments for a delivery by signing in a shipment transmission document. One signed copy is left for a Sender.
8.4. A Courier has the right not to pick-up unpacked, improperly packed, unlabelled or improperly labelled shipments. A Courier has the right not to wait till the shipment is be prepared for hand-over.
8.5. A Courier collects and loads shipments, not exceeding 31.5 kg weight limit, to the vehicle.
8.6. On request of a Sender, a Courier can collect shipments which each parcel weight does not exceed 31.5 kg to the vehicle and it is not necessary to have additional loading technique.
8.7. A Sender must load those parcels to the vehicle where loading technique is needed for loading.


9. Shipment delivery to a Receiver:


9.1. A Courier delivers a shipment to a Receiver by endorsement. A Receiver accepts the shipment delivered by the Courier during the period that allows avoiding baseless delay of vehicles.
9.2. A person accepting the shipment must indicate his/her own name, surname. There must also be written time and delivery date of the shipment in paper POD.
9.3. A shipment is considered as delivered and value added services (options), indicated in MDU or paper POD, are fulfilled when a Receiver or his/her representative accepts the shipment and confirms that by signature. A Customer that has ordered a shipment delivery service confirmation can view a picture of a Receiver’s (who accepted the parcel) signature in DPD website www.dpd.lt.
9.4. A Receiver must check parcels of a shipment during shipment acceptance time and in a presence of a Courier. If damaged parcels are noticed, a Receiver has to note that together with a Courier in a POD and fill-in a note/deed of parcel damage (check-in/inspection) presented by Courier.
9.5. DPD does not take any liability for a damage of a shipment or parts of it if:
- there were done no notes in a POD during the moment of shipment acceptance at a Receiver place or
- there was no deed of parcel damage (checking) filled in during the shipment delivery and a Courier presence.
9.6. If a Receiver refuses to accept a shipment or a Receiver was not found by the indicated address, a Courier notes the reason of undelivered shipment, date and time in MDU, the shipment is returned to DPD depot. A Sender is informed about this by the indicated email address. The shipment is delivered once more to the Receiver or returned to the Sender for additional delivery fee in case of the Sender’s errand.

 

10. DPD does not deliver:


10.1 Transit (not passed customs clearance) parcels in the EU territory.
10.2. Shipments and postal correspondence to post boxes, not packed, improperly packed shipments.
10.3. Forbidden goods for delivery:
- item of high value (jewellery, artwork, antiques, precious metals, the noble metals, gems, money, cheques, stocks, shares, papers and other documents and items, which are impossible to restore, reconstruct and (or) change by the items of same value in case of damage);
- arms, ammunition, explosives, drugs and substances or products which may be hazardous to human health, the environment or property due to their chemical or physical properties and which are included on Dangerous Goods List of the United Nations Experts committee on the Transport of Dangerous Goods; articles, goods, substances transportation (import, export, transportation) whereof is prohibited under the law of at least one of the states through the territory whereof transportation takes place;
- alive animals and plants, perishable food and items requiring special transportation equipment, safety means, permits or special conditions of temperature, humidity and other exceptional conditions.

 

Remark: a Sender is responsible for a content of a shipment. DPD takes no responsibility for accepted shipments containing goods, substances indicated in this section. DPD has the right to stop delivery and check the content of a shipment parcel by a commission written deed at any time. If it is suspected there are forbidden goods to deliver that can be hazardous to human health or other shipments, or are forbidden to deliver in territory of other countries, and DPD has not been informed about it, DPD takes all necessary safety requirements and has the rights to appeal to the appropriate state institution.

 

11. Claims:


11.1. If there is a claim for damage, losses and so on, a Sender (a Customer) has the right to present a claim to DPD according to the determined order during 7 (seven) work days from a shipment delivery day, but no later than by the term determined in the Post Law of the Republic of Lithuania (12 article 1 part).
11.2. Claims are not dealt with/investigated if presented after the determined period (6 months after a shipment dispatching date).
11.3. DPD must reply to a written claim in 15 work days from the date of claim receiving. An applicant is informed about fulfilment or declining of a claim in written form or by email.


12. DPD responsibility:


12.1. DPD indemnifies the damage of lost, damaged registered postal shipments according to civil code of the Republic of Lithuania, the Law of Post and other legislations from the moment of shipments‘ acceptance from a Sender till delivery to a Receiver.
12.2. DPD respond in written form to a presented claim for done damage for a Customer according to determined order followingly:


12.2.1. by the World post convention, guidelines regulations of postal correspondence and shipments for the damage due to lost, damaged international parcels.
12.2.2. for shipments sent in the Republic of Lithuania:


12.2.2.1. loss or lack – by the value of lost or lack of goods but no more than 1800 Litas (520 EUR) for one shipment parcel;
12.2.2.2. for injury - by the amount equal to the value of lack of goods in a shipment, but no more than it is indicated in 12.2.2.1.item.


12.3. Incurred indirect losses and unreceived incomes are not reimbursed.
12.4. DPD does not indemnify the damage for a Customer if:


12.4.1. Force-majeure circumstances appeared during the time of shipping due to which the shipment was lost, there was a lack of some goods or they were damaged and it is impossible to define what happened to the shipment as documents necessary for evidence are demolished and DPD guilt is indefensible otherwise;
12.4.2. Damage is done due to the guilt of a Sender who violated the requirements declared on www.dpd.lt and DPD requirements for package, sent goods packaging and labelling which were known for a Sender or handed over the goods imperative of thermal mode, improperly packed or labelled for a delivery.
12.4.3. Damage has occurred due to natural features of sent goods which caused total or partly loss of the goods: broken, corroded, crumbled, cranky, crushed, etc.
12.4.4. On the delivery moment shipment parcel was not damaged, shipshaped and there was no remark done by a Receiver about packaging violation in POD or there was not written a separate deed together with a Courier.
12.4.5. A Receiver has accepted a shipment and has signed in MDU or POD.
12.4.6. A Customer has not presented a written claim after 6 month of shipment sending day.


12.5. DPD is not responsible for an impounded shipment in the provision of the state institution legislations.
12.6. A Customer is liable for proper preparation of the shipment and documents, packaging and labelling of the shipment and reimburses DPD incurred losses and additional costs (including customs fines, storage or readdressing and return costs, etc. while sending/receiving parcels not in the EU countries) due to the fault of a Sender and/or a Receiver caused by improperly packed shipment, presented incorrect or wrong data, improper documents, inability to present appropriate data, necessary documents, permission or licences according to determined order of written claim.
12.7. A Sender is fully liable for a shipment, containing prohibited items, handed over on purpose or due to imprudence for a delivery to DPD and reimburses DPD incurred losses and additional costs including court, storage, demolition and other costs without reference to which country losses were suffered.
12.8. Any disputes and disagreements due to failure to comply obligations are solved in the negotiations of the Parties. If there is found no settlement between the Parties disputes are arbitrated according to the determined order of legislations of the Republic of Lithuania.


13. Change of regulations:


13.1. DPD updates shipment delivery regulations according to the need as there is improved shipment pick-up, sorting, and delivery technology, there are offered new services, geography of shipment, delivery is broadened while concerning the quality of services.
13.2. DPD declares the latest version of Regulations, rendered services, valid DPD pricelist and other information on www.dpd.lt.
